PIERRE, S.D. — an inmate who killed a South Dakota prison guard during a failed escape attempt should face the death penalty, the state Supreme Court ruled Thursday.

The high court unanimously upheld the death sentence Thursday. The justices ruled that the penalty is proportionate to the crime and justified by aggravating circumstances – that Robert killed a prison guard and the murder occurred during an escape attempt.

“This was not merely an escape attempt on the spur of the moment where events spiraled out of control. here the record reflects that Robert had been planning his escape attempt, which included the murder of a corrections officer, for well over a month. His planning stage included obtaining the lead pipe eventually used to kill Johnson,” Chief Justice David Gilbertson wrote.

The circuit judge was not influenced by passion or prejudice in sentencing Robert to death, but instead considered that Robert is dangerous because he has threatened to kill again, has a violent history, is unlikely to be rehabilitated and committed a severe crime, the Supreme Court said. The justices said their review of the sentence was particularly important because Robert has demanded to be executed.

“Robert’s persistent efforts to hasten his own death necessitate intense scrutiny to guarantee his desire to die was not a consideration in the sentencing determination. we do not participate in a program of state-assisted suicide,” Gilbertson wrote.

The high court said the circuit judge can issue another execution order.

South Dakota Attorney General Marty Jackley, who prosecuted the case, said he will ask the circuit judge to set an execution date. Robert’s execution by lethal injection is unlikely to occur for at least three or four months, he said.

Robert was already serving the equivalent of a life sentence – 80 years for a kidnapping conviction – so a death sentence is justified because another life term would not have increased his punishment, Jackley said.

“The death sentence is reserved for only the most brutal crimes that are committed. The horrific actions of Robert leave no other alternative and justify the sentence of death,” Jackley said.

Defense lawyer Mark Kadi, of Sioux Falls, said Robert seemed relieved that the Supreme Court will allow his execution. he wants it to be carried out soon and will not seek any last-minute delays, Kadi said.

“Just as he has not taken steps to pursue appeals in his case, he will not seek or accept any executive clemency,” Kadi said.

A second inmate involved in the escape attempt, 49-year-old Rodney Berget, also pleaded guilty and was sentenced to death, but has appealed his conviction and sentence. a third inmate, Michael Nordman, 47, was given a life sentence for providing the plastic wrap and pipe used in the slaying.

Johnson was working alone on April 12, 2011, his 63rd birthday, in a part of the prison where inmates work on upholstery, signs, custom furniture and other projects. Prosecutors said the two inmates killed Johnson by hitting him with a pipe and wrapping his head in plastic wrap. She was also working with The Voice coach Cee Lo Green, who is known for his distinctive personal taste. What was it like styling for a man who already has plenty of style?

“I was familiar with his signature red and his unique style,” Carter told me, “and since he was playing a singer in an old Detroit nightclub, I knew his red would fit in just perfect.  I heard that he wanted to wear a ‘conk,’ which is a style of straightening your hair for men in the 60′s a la James Brown.  Based on that fact I chose a fabric that was a shark skin, iridescent fabric.  When Cee Lo arrived, I presented the ideas and he walked right into it.  The one thing he asked for was a black shirt with ruffles, and that combined with the black lapels was perfect.”

What was her favorite design from the film? “We combined jewels to make into fabric on one set of stage dresses that were modeled after Donyale Luna, a Detroit-born super model of the sixties,” she said. “It was a costume I awaited anxiously to be finished and worn.  I think everyone was awaiting their reveal, because people who came by to see our costume shop were intrigued by their beauty during the construction process.”

In the future, Ruth would love to design for a pair of popular singers: Pink and Lady Gaga. Her next project, however, is the Lee Daniels-directed film The Butler. “It’s thrilling to say the least,” she told me. “From Forest Whitaker to Oprah Winfrey to Minka Kelly and Vanessa Redgrave, I am honored to be in the position to design for them, and each and every one has shown a level of professional behavior that makes them part of a very special level of actors.”

Dangerous Product #1: Mineral Powder – When you use mineral powder, the tiny nano-particles that make up the powder become aersolized particles and get into our lungs and can scar our lungs. When you blow small bubbles, you will notice that they descend quickly. this is what happens with the small nano particles in mineral powder. once the powder gets into our lungs, its nearly impossible to get it out and it can cause fibrosis.

Dr. Arthur Perry, author of Straight Talk about Cosmetic Surgery (Yale University Press Health & Wellness) (which I may just have to pick up at this price), said that these same non-particles cause serious problems in industrial use, and we have seen it in miners and construction workers. however, it takes 10-30 years to see the damage, and these mineral powders are fairly new. but I don’t want to find out that I have serious lung issues or even lung cancer in 10-30 years from using mineral powder So lets not take the chance and be guinea pigs Here are save alternatives:

- Liquid Foundation with Shimmer

- Cream Blush or Bronzer

- Packed Foundation or Pressed Powder

Dangerous Product #2: Wrinkle Cream - When you put cream on your face, it goes through the dermis and into your blood vessels, where it gets absorbed into your body. and anything that you absorb into your body you should question and worry about, because this can cause all sorts of allergies and even collagen breakdown.

Dr. Paula Begoun says that expensive does not mean better and natural does not mean anything either (there are bad and good synthetic and natural ingredients). there are tons of ingredients that sound like they would be great, but can actually make wrinkles worse including fragrances, lavender essential oil, eucalyptus, and peppermint essential oil. Both Dr. Begoun and Dr. Perry (as well as Dr. Oz of course) agree that if wrinkle creams claim that your wrinkles will go away immediately or that its the same as botox, they simply aren’t true. Dr. Oz says that when you are looking for a good face wrinkle creams, make sure it meets the following criteria:

- Color Free, why have extra chemicals to make colors when its not necessary?

- Vitamin a (Retinols) is perhaps the super drug of wrinkles according to Dr. Perry and Dr. Oz

- Vitamin C is a collagen builder

- Alpha Hydroxy Acid works to exfoliate your face

Dangerous Product #3: Lip Gloss – Most lip gloss comes from petroleum jelly, and when you put it on your lips, some of it inevitably gets into your stomach. so you are basically drinking gasoline. Petroleum Jelly is fine outside of your body, but you do not want this stuff inside of your body. Dr. Oz really put it into perspective when he said that if you use 2-3 tubes a month for 10 years, then you will be consuming roughly 7 pounds of petroleum jelly.

Dr. Perry said that petroleum jelly, when ingested, may even cause cancer. in the EU (European Union), petroleum jelly is banned, except for when it is very pure. in the USA we don’t know which forms of petroleum jelly are pure and which are not. They have done studies and found that women with breast cancer have twice the levels of these products in their breast tissue than women who don’t have breast cancer. now there is something to think about So Dr. Oz gave some safe alternatives to lip gloss:

- look for lip gloss with zinc oxide, because by making a reflective surface on your lips, you get more sun on your lips.

- use natural beeswax lip gloss. my favorite is The Body Shop Satsuma Shimmer Lip Balm, made from community trade beeswax from Zambia. and if you want a bit of extra color, The Body Shop Lip Color is also fabulous and made of their community trade beeswax

- Wear sunscreen under your lip gloss.
